Truecrud you can view the ended actions. 2 shows up for that item when I searched after reading your plight. So sorry brother. I hope you get it worked out.

I couldn't find the second completed listing. What did the backstabber finally get for the item? I would've figured this jerk wouldn't have been so foolish and relisted the item for a different price. I bet he sold it privately through paypal!!
That is just so wrong...I feel bad for you Truecrud....The seller is unscrupulous and hopefully karma will come back and bite him. E-Bay has to get some more teeth. Giving this seller negative feedback is a joke. He's just going to create a different E-Bay account under a new e-mail address...simple as that.
Truecrud, what did this fool give as his reason for trying to refund your money? Unfortunately for you, I think it's a loss at this point....I would try to inconvenience this guy as much as possible but I don't think you'll ever hold that Combattra in your hands.
I know it's no consolation, but a lot of us here on RJ don't own a Combattra yet either. Keep us apprised of the situation. Good luck!

Sorry to hear about the canceled auction. I definitely agree with all said here. Don't share your finds until they are in your hands, and be wary of 0 feedback sellers.

That is terrible!
I actually was looking at my Combattra today with repro stickers and new repro Yo-yos courtesy of Bourno and was depressed thinking how much I paid for it compared to your perfect one.
But I was still happy someone had found a score like that- it gives us all hope- I actually was searching on ebay for "voltron lot" to attempt to recreate your luck.

Well eBay told me today that I am basically screwed and there is nothing they could or would do for me then hung up on me. I searched for contact info but it said there is none which "is an error and needs to be reported" All I can do is warn the people here not to deal with mthornbeek (michael.hornbeek@gmail.com). I gave him negative feedback (seems Pointless), and wish bad things to happen to him. I wonder if there is any legal action I can take?

I'm sorry, but as a seller, it is easy for selecting a reason for refunding or canceling the transaction. Like, "item was damaged", "item not available any longer", etc.
And this was a new seller that had no accumulation for positive feedback and would want to keep it un-blemished.

there sadly is no legal action you can take over this, only if he took your money and ran off. but since no money was lost there is nothing real that can be done expect enjoying the money you still have and making the most off it. i am glad he got a neg though he deserved it.

I'm no lawyer, but I believe a contract can be voided within 24 hours, maybe 48 hours, but that would depend on the laws of the individual states. Even if you wanted to contact a lawyer and start a legal action, you must realize that you could be spending more on lawyer fees, court costs, etc than the cost of the Combattra.
Hypothetically, even if you win a judgment against this deadbeat, what is the court going to impose? I would venture to say they'd order him to return the money. He would say that the Combattra is no longer for sale or that he already sold it (take whatever he says with a grain of salt).
Then the whole issue of how you would get him into court begins. He must be served with a subpoena and up to this point, nobody knows his true name or address, d.o.b., etc.....so service of the court document is all but futile.
It would cost you thousands of dollars for a lawyer to subpoena 'gmail' and get the residential address for the IP account.
I'm not trying to discourage you, but I just want you to realize that you have an uphill battle. This guy is a total tool and E-Bay ought to be ashamed of itself. Even if E-Bay 'forced' him to make the deal (can't see how), this fool seems like the type who would break off the head antennae's or do damage to Combattra in some other way.
Sorry to be such a downer, I just want you to understand the realities of taking legal action. Hey, it might not hurt to consult a local lawyer, if he doesn't want too much $$ for a consultation fee. It might be worth it....some lawyers will take a case 'pro bono' just for the notoriety (small consumer vs. E-Bay definitely fits that bill) or the chance to make big $$ at the end. If you're that passionate about keeping the fight going, stop by a lawyers office and explain the deal. They sure as hell know much more about the pursuable legal avenues than anyone on this forum, including myself, do.

im not sure ebay can support much in the way of legal action. i bought something about 5 years ago that was a big ticket item. the guy decided he didnt want to sell and i tried the "im gonna sue you!" route. it didnt work. ebay wrote me back saying that their terms are very simple - we cant make anyone put an item in a box and send it to you. you are free to leave negative feedback and use ebay to find another one. i stiffed a seller by accident once, but he was such a jerk that squaretrade/paypal refunded my money when he responded to mediation with expletives. the guy called the cops on me and they showed up at my door. they asked if i was willing to send back the money since i had the item. i asked if i had to and they said no. i closed the door in their faces. and i think they were working off of ebay emails via the seller.

Just let it go and buy another. Just keep the search on and you'll get a good deal. I've been waiting for 2 years to pick up a Godaikin Golion for a great deal, or under $300, and have lost every bid battle for one. 2 weeks ago I finally got one for $100. I know you won this and then the buyer shafted you, but you'll find another. You should message a few of the other sellers that have one and send them offers. Sometimes they will bite and just sell it to you. Of course if Ebay left a bad taste, explore the net and you may find the item your looking for in a direct purchase from a shop.
