I don't know if it count as a 3rd part product since Takaratomy gave sentinal permission to make it. He doesn't transform but the head can detach and transform into Zorak and he has articulation. So I think its a good trade off to have an articulated Scorponok in scale with Fort Maximus. Sentinal is the company behind the rio-bone line so this should be a good toy.

Any company other than the primary license holder (takara-tomy) making something is 3rd party. In this case, it's 3rd party licensed as opposed to 3rd party unlicensed. 3rd party doesn't automagically mean "not official" as long as it's licensed.
