In your situation, you are advised to contact the seller and then cancel the transaction via "Unpaid Item Process". On this process, the seller may file a so-called "friendly" Unpaid Item Dispute, which will have no negative effect on your account. The seller can either contact us for more information on how to do this but the seller might appreciate you forwarding him/her this information. For this purpose I have copied it for both your reference and the seller's below: When the seller file the Unpaid Item Dispute, he/she can choose "We are both agreed not to complete the transaction" as the reason of the report. If you confirm the seller's statement about mutual agreement not to complete the transaction, you will not receive an Unpaid Item strike and the seller will receive a Final Value Fee credit. Even if you don't respond to the email or pop-up message within 7 days, the seller will be able to close the dispute and receive a FVF credit, without strike on your account. Now, what should I do when I know that he will not reply to my email? I have emailed ebay CS again about this case and ask to drop all the charges against me.

I don't know what to tell you, bro... perhaps you should keep a record of all those emails and print them out on paper, then go see an attorney right away... perhaps an attorney may be able to help you out of that mess.
It's not fair: that sh*thead gets away with ripping people off, and eBay threatens to close your account. It's just NOT FAIR.

What’s unclear is either eBay’s policy towards scammers has loosened up for the worse or in this case a larger case is being built against baronkarlo to get him nailed, tossed out and gone from the world of online selling.
As it stands the interesting thing I will say about the eBay reports I filed is past the auto-replies I got, I have not gotten the more official follow-up e-mail from customer service saying they have investigated and will take action but they cannot tell me specifics, etc, etc, etc... I’m hoping the level of this guys scams and past history means something bigger is happening.

For whatever magnitude of his scams may be (and I know it's Huge) I'm sure it will all catch up with him sooner or later... ...it will all be exposed and brought to light, on the news and in the papers; and eBay will have to revamp their policies so they'll be more diligent in protecting consumers... With shady characters like that Baronkarlo dude, eBay cannot afford to have a fire under their ass or they could lose business. According to ebay's policy, buyer can always get back the money if seller is not shipping. Ebay/Paypal will charge his credit card regarding the money he cheated. If this is the case, how can this guy cheat the money after all? just my query? thanks

Apparently refunds due to non-delivery aren't covered by PayPal in Italy because of "disposable" credit/debit cards and now he's used that loophole to purchase an $800 unlocked iPhone 4.” Basically, there is some kind of quirk in the way PayPal works in Italy that allows anyone to collect funds via PayPal and then transfer them to a “disposable” credit/debit card. And then they can cash out that debit card. Which means PayPal has no source to withhold money from. Which means “buyer protection” in Italian PayPal transactions simply means “caveat emptor.” According to buyers and sellers in Italy, the more reliable alternative in Italy is PostePay which is connected to the Italian postal service and considered more secure for transactions. Also, no disrespect to anyone who is truly panicked or has unfortunately bid on this guy’s auctions, but the signal-to-noise ratio in this thread is a wee-bit on the noisy/gossipy side. “Watching the pot boil” posts like “I am a winner... Wait, now I am not! Help me! Wait, I am fine...” are really counter-productive to all. This is a message board, not a chat room. All the details of who this guy is, how he operates and his history are in this thread. Adding posts espousing “why” he does this or theorizing on how he might be a “murderer” ( ) is just sensationalistic. The guy is a scammer. He is well known. And that’s it. Re-read this thread. And if you don’t get it, re-read it again. And if there is something eBay specific, there is advice in this thread. And past that you can contact eBay and even call eBay to talk to a real human being. I have called them in the past and while it takes some time, it will solve your problems more than asking the same question over and over on a message board will.

My friend has paid him and disputed through paypal, he was fortunate to get his money back today, not sure how paypal is recovering money from this scambag!

Unfortunately, I was the winning bidder on one of this scumbag's listings. I paid immediately through paypal then he sent me a bogus tracking number after 3 days. When it was not giving me any details even after a week, I did a search for his ebay id and it led me here. I immediately looked back at the details of the shipping and the expected receipt date showed was june 16 which was seemed to me was such a long time even though I paid on May 9. I immediately opened a case with ebay via customer support phone since the online system would not let me open one up yet (yep! he did think things through). Escalated to a claim after seven days. Waited 3 days and got my refund today .Not sure where the money came from, though it did show his name (Carlo Caravatti) on the paypal refund. Honestly, I was a bit worried since I read here how Italian paypal users can empty out their paypal accounts onto prepaid cards.

I know in certain cases, ebay/paypal will hold the funds for 21 days or until positive feedback is left for the item in question. Actually happened to me once until I contacted the buyer to leave feedback, and the funds were released immediately after that.
If this happened to this guy, paypal will not allow him to withdraw the cash from his account, and he shouldn't be able to profit from the scam. A small consolation, I guess.

I am happy to hear that all victims can get their money back, this is the most important. this scambag is really wasting people time and making people worrying. By putting out a hundred items out for sale with the intention to cheat big money is really a serious event. Remember that this scambag only took action after receiving over 300 positive feedback, how he pulled money from Paypal and how Paypal can refund money to victim remains a mystery. He did manage this cheating event for a long time, if he is not going to jail, he may definitely show up some other days in future, beware!

They ended around the 9th or the 10th. In my case, he did give me a tracking number but when I questioned him as to why it wasn't giving me any details, he stopped responding.

Negative feedback can simply be granted if no response. For refund, if one cannot receive his products within 10 days after paying paypal, refund will be feasible.
