First purchase and box was open and damaged. They sold me a used item as new. They refuses to refund or offer a return. Buy at your own risk. According to Nippon-Yasan's FAQ page: "All the new products have manufacturer's warranty in Japan and we can make it work for you! We see it directly with the maker! If you have any problem, contact us as soon as possible to know if your problem is covered by the warranty or not!" If the item was listed as new or never opened, and it did not come as described, you have a right to claim an exchange or refund. Otherwise, take it to your Credit Card company or PayPal.

It is unfortunate that it fell on you but it is not our responsibility. There will be no refund partial or total." Does that sound like a refund being offered?

Based on her reply, it sounds like she was answering your inquire about the box being open. But she does not mention anything about it being broken.
Just escalate it again, and say that you want for her manager to get into this. If everything fails, you should escalated to your credit card company or Paypal on the grounds that it did not came as described. both Credit Card and Paypal can get the ball rolling from there.

By the way, she is the same gal who denied a recent request to has my orders combined,
So I pushed it back to her stating that they combined orders for me before. It sounds to me that (a) she is new and does not know crap, or (b) she is just does not want to deal with customers requests.

If the item you received is not as described in any way, and you are not getting anywhere with the seller, regardless who it is, you should immediately file a dispute with your credit card or Paypal (if used). Don't feel sorry, don't try to continue to work it out. Just make your rights known right away and let the seller know you are not willing to play games with your money. }D

By the way, she is the same gal who denied a recent request to has my orders combined, So I pushed it back to her stating that they combined orders for me before. It sounds to me that (a) she is new and does not know crap, or (b) she is just does not want to deal with customers requests. Thanks bro! Good advice ill try that

According to Nippon-Yasan's website you have 7 days to dispute and return an item that was not as described. So I will strongly recommend you to contact your credit card company or PayPal as soon as possible to open a dispute.
This should force Nippon-Yasan to rectify their screw-up, so do not delay!

Sorry you had a bad experience with Nippon-Yasan. I've been buying most of my Macross items from them and so far have not had any issues. Hope you get some form of resolution.

The limited edition box contains the actual toy inside it's own box and the extra items, so their are two boxes. Was the toy box actually opened? Sorry to hear about your issue. I ordered a MP soundwave from then and had no issues.

I ordered a MP soundwave from then and had no issues. based on the way the plastic casing was it did look like someone opened the inside box too, but just to check i think. I dont think the item was taken out or posed. I understand mistakes happen, but its about service and offfering a remedy know? They werent very cool about things, thats my main problem. But to be honest I have mixed feelings about NY. Prior to this purchase I bought the wrong item and they refunded my money no questions asked. So its been inconsistent

I purchased a Takara Tomy Transformers Alternity Nissan Fairlady Z A-02G Galvatron on ebay from blade_kid. Price was reasonable, shipping however took over 3 weeks! When I opened the package there was a Banzai Tron figure inside, not Galvatron. Contacted seller and they admitted to sending the wrong item, and wanted me to pay return shipping to return the item for a full refund or send them $50 more to get Galvatron and keep Banzai Tron. I said that since this was their mistake they should send me a pre paid label for return shipping and I only want the robot I ordered, not other items. They tried again to get me to pay for return shipping. And I again said that is not fair to me. Now they are promising to send the Galvatron to me (for free) if I close the ebay case. So I am asking you all, this is a bad idea right, as if I close the case I lose any ability to escalate the issue to ebay right? Can I reopen a closed case?
Seller (Blade_kid) has 100% feedback but this reeks of a scam. Thoughts?

DO NOT CLOSE THE CASE BY ANY MEANS! Once you do you can't reopen it. Just escalate it like cff said and let Ebay sort it out. Did you pay with Paypal? I always deal with paypal rather than Ebay when any transaction goes sour. Good luck bro! Keep us posted. }D

On the other hand, you can tell them to send you the figure first with a tracking number and that you will close the case once you receive it and verify it is okay. That should be the only other option for you.

Although its the seller's mistake, in order to get your money back from this claim, ebay or paypal will still require you to pay for the return shipping. Both you & the seller will only lose out in such a deal.
I would think the easier way out is to keep that Banzai Tron and ask for a better price say $25 instead of the $50 and resale it later. Let him ship out the Galvatron first before anything else.
